Terms & Conditions

1. General
These Terms & Conditions govern the purchase of products from Yabatu.
By placing an order, the customer acknowledges that they have read and accepted these Terms & Conditions.
All Yabatu products are handcrafted from genuine natural stone. As each piece is individually carved, no two products will ever be identical.
2. Product Assurance Policy
Rather than offering a fixed-period manufacturer's warranty, Yabatu is committed to delivering products of exceptional craftsmanship through a comprehensive quality assurance process. Every product undergoes multiple stages of inspection throughout production, including:
- Selection of premium natural stone blocks
- Inspection throughout carving and finishing
- Dimensional verification against approved specifications
- Surface quality inspection
- Water testing (where applicable)
- Final inspection prior to dispatch
- Secure export packaging suitable for international transport
Prior to shipment, completed products may be photographed and shared with the customer for confirmation that the product aligns with the agreed specifications and overall appearance.
3. Natural Stone Characteristics
Our products are manufactured from genuine marble, onyx and other natural stones. Natural stone is an organic material formed over thousands of years. Variations are inherent to the material and contribute to the uniqueness of every piece. These natural characteristics include, but are not limited to:
- Colour variation
- Veining
- Mineral deposits
- Natural pores
- Pinholes
- Filled cavities
- Surface movement
- Natural fissures that do not affect structural integrity
- Pattern variation
These characteristics are not considered defects and do not constitute grounds for cancellation, refund or replacement.
Product images, samples and marketing materials are representative only and should not be interpreted as an exact representation of the finished product.
4. Dimensions and Manufacturing Tolerances
As every product is handcrafted, minor dimensional variations may occur.
Unless otherwise agreed in writing, manufacturing tolerances of approximately ±1 cm are considered acceptable and do not constitute a defect.
5. Orders
An order is confirmed once Yabatu has accepted the order and any required deposit has been received.
Lead times provided are estimates only and may vary due to production scheduling, availability of natural stone, shipping schedules or circumstances beyond our reasonable control.
6. Custom Orders
Unless otherwise stated, all Yabatu products are made to order.
Once production has commenced, custom orders cannot be cancelled, modified or returned.
Deposits paid for custom orders are non-refundable except where required under Australian Consumer Law.
7. Installation
Products must be installed by suitably qualified professionals.
Customers are responsible for ensuring:
- adequate structural support
- compliance with local building and plumbing regulations
- correct waterproofing
- appropriate lifting and handling during installation
Yabatu accepts no responsibility for damage arising from incorrect installation, inadequate structural support or improper handling after delivery.
8. Inspection After Delivery
Customers should inspect all products immediately after delivery.
Visible freight damage, shortages or manufacturing concerns should be reported to Yabatu within 48 hours of delivery and before installation.
Installation of the product constitutes acceptance that the product was received in satisfactory condition unless otherwise required under Australian Consumer Law.
9. Freight and Shipping
Risk transfers to the customer after delivery.
Where freight damage is identified, customers should:
- note the damage on the delivery documentation;
- retain all packaging;
- provide photographs of both the packaging and product; and
- notify Yabatu within 48 hours.
Shipping charges are non-refundable unless otherwise required under Australian Consumer Law.
10. Storage
Following delivery, products should be stored indoors on a level surface in a clean and dry environment.
Damage resulting from improper storage, exposure to weather or mishandling after delivery is not the responsibility of Yabatu.
11. Returns and Refunds
As our products are predominantly handcrafted and made to order, Yabatu does not accept returns or provide refunds for:
- change of mind;
- colour, veining or texture variation inherent in natural stone;
- natural characteristics described in Section 3;
- minor dimensional tolerances;
- incorrect product selection by the customer;
- delays outside Yabatu's reasonable control;
- damage caused after delivery;
- incorrect installation;
- misuse;
- failure to follow the Care & Maintenance Guide.
Returns and refunds are only available where required under Australian Consumer Law or where otherwise agreed in writing by Yabatu.
Returned products must not have been installed and must remain in their original packaging unless otherwise agreed.
12. Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies available under Australian Consumer Law.
Where our goods fail to meet a consumer guarantee under Australian Consumer Law, customers are entitled to the remedies provided by that legislation.
13. Limitation of Liability
To the maximum extent permitted by law, Yabatu's liability is limited to one or more of the following:
- repair of the goods;
- replacement of the goods;
- supply of equivalent goods; or
- reimbursement of the purchase price,
as determined in accordance with Australian Consumer Law.
Yabatu shall not be liable for indirect, consequential or incidental losses, including project delays, loss of profit or third-party costs, except where liability cannot be excluded by law.
14. Force Majeure
Yabatu shall not be liable for delays or failure to perform obligations arising from events beyond its reasonable control, including but not limited to natural disasters, port congestion, shipping disruptions, industrial action, pandemics, governmental actions or other force majeure events.
